Question: paid a full year rent, unit sold with 6 month left before yearly rent due. Does the landlord need to refund unused rent ?
Answer: Without knowing in detail what the rental agreement said, it is impossible to say exactly what should happen in your situation, but, as a general rule, a landlord has a duty “mitigate” (A.R.S. 33-1305(A)) – that is, a duty to do their best to reduce – any monetary damages the tenant suffers as a result of the tenant’s own breach of the rental agreement (for example, by vacating early).
