Question: I have been taking care of my boyfriends dad 24/7 for over a year and was promised i would be paid when they were able establish Gardianship.and access his accounts what do i need to have as proof that i took care of him.
Answer: Retroactive pay is difficult to obtain. You can try to prove that you worked based on a Caregiver contract. If the agreement was written, that is ideal; if verbal, you can ask the promisor to now put it in writing (best to be “under penalty of perjury” in an Affidavit.) Without any contract, you can try to prove the actual work you performed (a record of hours worked, continual receipts for groceries, witness statements, etc, which might validate your claim under a “quasi-contract” theory but this is more difficult and doesn't necessarily help quantify your salary amount. The majority of private-sector workers in Arizona are employees "at-will." Employment on an "at-will" basis means the employment is not covered by a written contract, but the agreement is established before work starts and the employee is paid from the start.
