Losing Spouse/Parent
questions & answers
Question: If my parents die in Phoenix, AZ and want to be cremated and have me take their ashes to OR to be buried, what is the proceedure I need to make?
Answer:
Each state has different laws regarding public health and safety. In Arizona, the laws concerning public health and safety are included in Title 36 of the Arizona Revised Statutes (A.R.S.). Chapter 7 of Title 36 (beginning with A.R.S. § 36-803) contains laws regarding disposition of human bodies. A.R.S. § 36-831 discusses burial duties and A.R.S. § 36-831.01 discusses the duty to comply with the decedent's wishes in specific situations that are mentioned in the statute.
If a person has specific wishes that he wants to ensure are complied with at the time of his death, that person may want to consult with an attorney to find out more information about how the laws apply to his specific situation.
