QUESTIONS

  • I live in TX. My daughter and her mother moved to AZ 2 years ago. I paid support and maintained telephonic contact. During this time, unknown to me, the mother became a heroine addict and gave temporary custody to the grandmother. When I was informed of the situation, I attempted to gain custody of my daughter and the grandmother, who worked for Pima Co. Superior Court, filed for permanent custody. With our court date set for Nov 4th and my plane and hotel paid, the court calls me and says they changed the date. Is that even legal with less than 24 hours notice? Do I have any recourse?
  • My husband was arrested for domestic violence. Do I have to let him stay in our shared home?
  • I was recently in a relationship with a guy who was verbally and emotionally abusive. We were living together for about 3 months and he was always yelling at me and I was getting very scared. After he held me inside our apartment and refused to let me leave I finally got out and moved out. I tried to keep things civil. He moved to out of state but he says he will come back. He calls the house I am staying at several times a day.  He breaks into my emails and talks to my friends. He threatens me and he gets very angry at times and calls me and says he will do stuff to me and he will do stuff to my friends . I was wondering what I could do. I am very stressed out and scared and I feel like it is getting worse and I need a solution. I looked up about an order of protection but Im not sure where to go and how to do it. Id like to stop him from contacting me, my family, and my friends. I feel that he may be emotionally unstable and have issues that could turn to violence. He says he is coming back to Arizona and I just want to protect myself, my family, and my friends.
  • My ex and I had a domestic violence issue where one party assaulted the other and property was destroyed. I declined to press charges at the time (May 2018), and the charges have been dismissed without prejudice since (June 2018). Can I change my mind and still pursue charges against the other party?

  • If an order of protection is obtained, and an appeal was rejected. In the even the order is then modified and granted with the modification, does the order of protection get extended? For example: original order granted 11/12/2015, but was modified and granted 2/2/2016 is the new date 2/2/2016 or does remain the date of the original service?
  • my violations are: Assault-no injury; disorderly conduct. Court date on January 29,2016. Released on signature. If the Plaintiff does not appear to press charges,will my charges be dropped? Because Plaintiff does not want to press charges. What is my next step aside from appearing in court? Do i need representation for this violations?
