Question: I was convicted of a 2 felonies (non-dangerous and non-repetitive) about 19-20 years ago. I'd like to now change my name but am concerned this might be a hang up. The reason i wish to change my name is simple. I don't like it, never have. most people who know me call me by the name i wish to use (first name anyway). what should I anticipate as objections or concerns? By the way, have only had one traffic ticket in the past 20 years.
Answer: In Arizona, there is no law that prohibits a felon from changing his or her name. However, the judge has discretion to approve a legal name change. The judge will consider the following factors before approving a name change: 1) Whether the person has been convicted of a felony; 2) Whether the person is making the application solely for the best interest of the person; and 3) Whether the person acknowledges that the change of name will not release the person from any obligations incurred or harm any rights of property or actions in the original name. (Arizona Revised Statutes ยง12-601.) The motion to change a name requires an explanation for the name change. Because the judge will be weighing factors like public safety against your reasons for wanting to change your name, it is important that you clearly state your reasons for wanting to change your name in your motion.
