Question: My son is 6 mos into a 15 mo drug program. This program will become part of probation when he is sentenced next mo. Will the court allow him to find a different program or wuld he go to jail so basically if he isnt on probation yet and hasnt been sentenced yet i am hoping the court will allow him to find another program without him being threatened with jail

Answer: You may speak with the judge who ordered the drug program and request a change. The diversion programs are at the discretion of the prosecuting County Attorney. Speaking with the your lawyer or the prosecuting attorney may be another option for you and your son, to determine if there are other programs he could enroll in.
