Question: I am having a baby girl and was wondering do I have to give her her father's last name or can I give her my last name? And my other question is can he take me back to court to change her last name?

Answer: Information about birth certificates can be found here: http://www.maricopa.gov/publichealth/programs/vitals/birthco.aspx. There is no law that says a child must be given the last name of the biological father. The rights of the father will depend on the actual status of the father, if you are or were married at the time of conception the law automatically gives the father more rights but a biological father can establish rights through the court. A child's name can be changed by the parent of child listed on the birth certificate up to a year after the child is born after that a court order is required to change the child's name.
