Question: My daughter is 9. She hates that she has to go to her dads every weekend (per current custody agreement) I have filed a modification. How can the judge take in consideration her feelings on the matter?

Answer: If the court deems it appropriate under the circumstances, though not required, in pursuant to A.R.S. § 25-405 (http://www.azlawhelp.org/viewquestions.cfm?mc=1&sc=1&qid=4997) , the court may interview a child in chambers to ascertain the child's wishes as to the child's custodian and as to parenting time.
