Question: My daughter has two children with her ex-boyfriend that she has lived with since 2010. He is refusing to pay child support. His name is not on the birth certificates. What is the next step? Do we need to file a petition with the court or contact DES first? I'm assuming he will have to take a paternity test. Thank you.
Answer: Your daughter will need to file a petition to establish paternity. The governing law is Arizona Revised Statutes, section 25-803, 25-804. She can find the forms she needs on the website for the Superior Court, Superior Court of Arizona.gov. She will go the the self-help center, click on family law and look for forms relating to paternity. There will also be instructions on what to do.
