Child Support

questions & answers

Question: My court order has required me to pay for medical insurance for my daughter which I have done. My court order also states that each party is responsibe for one half of all uncovered medical expenses. We currently are in a situation where our medical deductible has not been met therefore a total hospital bill is due in the amount of $2200 for my daughter. My ex wife is refusing to pay her half...what do I need to do?

Answer:

If you have a decree or court order that governs the payment of uninsured medical expenses, you can request that the court enforce its terms (if the other party is refusing to follow it).  (Uninsured medical expenses generally fall under the "support" category).  If the court grants your request to enforce, it is possible to obtain a judgment against the other party when monies are owed to you. There are links to instructions/forms below on how to get the support enforcement process started. The forms are listed by Arizona county.  If you do not see your county listed, contact your local superior court to ask about its specific procedures.
