Emancipation
questions & answers
Question: im 17pregenant and a ward of state would i be completly emancipated if i marry the childs father and could cps take my child if i did so?
Answer: Pregnancy alone does not emancipate a minor however, marriage does. A minor who is over 16 may marry but must have consent of their guardian. To learn more about the law on this issue read statute A.R.S. 25-102 it can be found here: http://www.azleg.gov/FormatDocument.asp?inDoc=/ars/25/00102.htm&Title=25&DocType=ARS Further emancipation and marriage are not grounds for DCS, formerly known as CPS, to remove a child from custody.
