Question: Hi , I had got my mismeanor set aside for I can get a job and qualify for rent Homes ! But everything thing is still bring poping up in there background report. So why is this still happening? And is there anything I can do to fix it ?

Answer:

In Arizona, the set aside works a little differently. It is not a true expungement. The conviction will still show up on your background check, however, the record will be noted that your conviction was set aside. Your best bet would be to bring a copy of the set aside paperwork and present that to the rental office. The paperwork is a legal document and will show that your conviction was set aside. This may help ease the mind of the person making the decision as to whether to rent to you or not.
