Question: If an intruder breaks into my apartment at night and I hurt him before I know if he is armed, can I be charged with assault or anything else?
Answer:
The Arizona Revised Statute that governs assault is A.R.S. § 13-1203. A.R.S. § 13-418 contains justifications for defense of a residential structure. The decision to charge a person for assault or any other crime would be made by the police, district attorney, or attorney general.
