Question: My former wife lives in a home that has both our names on the deed. I have not lived there for over 40 years. Do I have any liability and if so how can I protect myself?

Answer: If a person is listed both on the note and the deed of trust, the individual may be considered a borrower by the lender. Contact the lender to determine if you are liable for the mortgage. Also, contact an attorney to determine if providing a copy of the divorce decree will release you from liability.
