Question: Can you tell me what has to be done to appoint a new trustee to a family trust. Also, is there anything that has to be done when a trustee resigns due to health problems. Trust was made in AZ
Answer: The duties, responsibilities, and replacement of trustees are governed by statute. Arizona Revised Statutes, Section 14-10704 discusses the vacancy of a trustee in a trust when the trustee resigns, dies, is disqualified or removed. Section 14-10705 States that the probate court must approve the resignation of a trustee and approve a replacement. You can find the statutes on the Arizona State Legislature's website, azleg.gov. Also, consult the trust documents to look for a provision about replacing a trustee.
