Question: We got a five day eviction notice and we offered to pay the rent in full within the five days and the landlord refused it he said if we didn't have it all that day it would be illegal to take the money
Answer: The residential landlord/tenant act specifically provides that after the delivery of a five day notice and before the filing of a special detainer action, "...the rental agreement shall be reinstated if the tenant tenders all past due and unpaid periodic rent and a reasonable late fee as set forth in a written rental agreement." ARS 33-1368 B.
