Landlord and Tenant Rights and Responsibilities
questions & answers
Question: I signed a lease before property management would show me the apartment. I have not moved in and I am very unhappy with the apartment can I legally break lease. I never was given a copy of my lease agreement either.
Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly (http://www.azlawhelp.org/articles_info.cfm?mc=5&sc=36&articleid=151). According to A.R.S. § 33-1322, if there is a written rental agreement, the landlord must provide and deliver a signed copy of the rental agreement to the tenant. The tenant must sign and deliver to the landlord one fully executed copy of such rental agreement within a reasonable time after the agreement is executed. A written rental agreement shall have all blank spaces completed. Noncompliance shall be deemed a material noncompliance by the landlord or the tenant, as the case may be, of the rental agreement. Carefully review the terms of the lease regarding its provisions for early termination. For additional information regarding landlord and tenant rights, read the Landlord and Tenants Rights and Responsibilities article (http://www.azlawhelp.org/articles_info.cfm?mc=3&sc=24&articleid=25), available on this website, has useful information regarding responsibilities of landlords and tenants.
