Landlord and Tenant Rights and Responsibilities
questions & answers
Question: does apt complex have to disclose the previous renter was a smoker?
Answer: The Landlord Tenant Act lays out the responsibilities of landlords in Arizona. Although there are several disclosures that the landlord must make, smoking habits of previous residents is not listed as a requirement. Additionally, Arizona laws that prevent smoking in public or common areas of residential rental buildings do not apply to individual units even if smoke can travel into other units (Environmental Law Institute).
