Answer: According to Arizona rules for eviction actions all attorneys must act in “good faith,” which means honestly and ethically. If you can show a court that the attorney misled or lied to you in order to obtain your signature, a judge is allowed to fine or charge the attorney for his actions. The State Bar of Arizona also requires all attorneys to be honest and ethical. If you believe any attorney working in Arizona has lied or misguided you in any action, you may report your concerns to the bar by calling (800) 319-0514 (ext. 7280). 17B A.R.S. Rules Proc. Evic. Act., Rule 4 A court may be willing to change a decision under certain circumstances. A person can file a motion requesting the court reconsider their decision if the decision was made because of a mistake, surprise, fraud or misrepresentation. This motion must be filed with the court within reasonable time, meaning as quickly as possible. The court may hear the case within 3 days, as an emergency matter, if a person has been evicted. 17B A.R.S. Rules Proc. Evic. Act., Rule 15 Even when an agreement is in writing, a court may refuse to enforce the agreement if you can show that there is a good reason because it is fair. 17B A.R.S. Rules Proc. Evic. Act., Rule 19
