Question: Death of my mother and landlord will not let me into apartment to remove her belongings. My mother had no will or power of attorney. Please help.
Answer: In typical leases, a renter authorizes someone to take possession of their property upon their death (A.R.S. Section 33-1314(F)). Alternatively, the landlord is obligated to turn over any property belonging to a deceased tenant with a court order appointing the “personal representative” of the estate. As an “interested party” you can begin an “intestate” probate proceeding with the Probate court for the county in which your mother died, and request to be appointed personal representative”.
