Answer: As a very general rule, so long as a tenant’s immediate or potential obligation to pay a particular fee appears in the rental agreement, and the fee itself does not contravene any provision of the Arizona Residential Landlord and Tenant Act (A.R.S. 33-1314), then that fee is permissible. (In other words, the purpose of the fee must be lawful and the tenant must have consented at some point to paying such a fee.) It is unclear from your question what the $40 is for in this case. Is your fiancé on the lease as your co-tenant? If you intend to have your fiancé live with you for the duration of the rental agreement, then you may want to make sure that your fiancé's name is added to the lease.
