Landlord and Tenant Rights and Responsibilities

questions & answers

Question: Our landlord gave us 1.5 hours to complete the move in forms. Even though we asked for more time by leaving the form with us. She demanded that she had to be there to compete it with us but that she had an appointment and both parties were on a time frame. I want to know how much time Arizona gives a tenant for a move in form. Did we have the right to request more time and the right is she couldn't be there to complete it on our own?

Answer: Arizona law does not address the question of how much time a tenant should be given to complete a move-in form, but there is no reason why a landlord should insist that the tenant complete it in the landlord’s presence. The Arizona Residential Landlord and Tenant Act says only that the landlord must “furnish the tenant with ... a move-in form for specifying any existing damages to the dwelling unit” (A.R.S. 33-1321(C)). If a landlord fails to provide a tenant with adequate time to inspect the unit for existing damages and complete the form, then in theory the landlord may be in violation of A.R.S. 33-1321(C).
