Question: If I have evicted our tenant for non payment and have a judgment against our tenants for non payment of rent can I deduct the amount of the judgment from the security deposit?
Answer: The Arizona Residential Landlord and Tenant Act states that “upon termination of the tenancy, property or money held by the landlord as prepaid rent and security may be applied to the payment of all rent...” (A.R.S. 33-1321(D)).
