Question: Can new manager file 24 hour immediate eviction for unpaid rent. I don't have proof rent paid.
Answer: Under Arizona law, a residential landlord is required to follow a very specific procedure in order to evict a residential tenant for nonpayment of rent. Under the Arizona Residential Landlord and Tenant Act (which applies to rented apartments, condos, single-family dwellings, and mobile homes when the tenant is renting both the mobile home and the mobile home lot space from the same landlord), the landlord must give the tenant a 5-day pay or quit notice. Only after 5 days have passed and the tenant still owes money may the landlord go to court to file an eviction complaint against the tenant (A.R.S. 33-1368(B)). Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act (which applies to mobile homes when the tenant owns the mobile home but is renting the mobile home lot space), the landlord must give the tenant a 7-day pay or quit notice. Only after 7 days have passed and the tenant still owes money may the landlord go to court to file an eviction complaint against the tenant (A.R.S. 33-1476(E)).
