questions & answers
Question: I have lived in my home for 21yrs. My ex has the loan and I am on the deed (title). We seperated and he moved out about 8 years ago. In 2016 he filed a breech of contract claiming I didnt put in my share, wants a quiet title and wants me out. He was granted a default judgement against me. I filed a motion to vacate judgement and was denied with the final judge stating I had to metorious agrument and was not credible although 3 judges before that one disagree and have denied all his motions. I am filing an appeal. Would I be the plaintiff or the defendant? I need legal aid, who can help me?
Answer: The person who files an appeal is called the “appellant,” while the party who responds to an appeal is called the “appellee.” The Arizona Rules of Civil Appellate Procedure are available here: https://govt.westlaw.com/azrules/Browse/Home/Arizona/ArizonaCourtRules/ArizonaStatutesCourtRules?guid=N0854C3F0715611DAA16E8D4AC7636430&transitionType=CategoryPageItem&contextData=(sc.Default).
