Question: If I am trying to evict my roommate, do I follow the landlord/tenant directions for an evection, or are there other directions?
Answer: If your roommate is leasing or subleasing from you then you would proceed under the provisions of the Residential Landlord/Tenant Act. If you are both on the lease or part of a rental agreement then the landlord would have to initiate any eviction action. If the persons conduct amounted to "domestic violence" (which can apply in certain roommate situations) or constituted "harrassment" then you could pursue either an Order of Protection or Injunction against Harrassment.
