Question: I own a note on a mobile home located in Tucson, AZ. The buyers are behind on their payments. How do i evict them since it is not rent.
Answer:
It is not clear whether you are referring to a mortgage or deed of trust and therefore discussing foreclosure or whether you are speaking to some other type of arrangement. Title 33 of the Arizona Revised Statutes (A.R.S.) contains laws relating to property. Chapter 6 (beginning with A.R.S. § 33-701) of that title contains laws about mortgages, Chapter 6.1 (beginning with A.R.S. § 33-801) contains laws about Deeds of Trust.
If you are not sure whether what you hold is a mortgage or a deed of trust, you may want to have an attorney review the paperwork. In addition, you may want to consult with an attorney to find out how these laws, as well as others, might apply to your specific situation.
