Question: Goodmorning, my tenant asked to break lease four months early leaving in March. I have started looking for a new tenant thru realtor, he is supposed to leave march 31st but he says he may not have anywhere to go so he might stay what happens if we find new tenant but he has not mved out. Can he stay after he gave written notice he was leaving early
Answer: As a general rule, once a tenant has provided a landlord with formal notice of that tenant’s intention to terminate the lease on a specific date, and the landlord has acknowledged receipt of that notice, then the tenant must vacate the unit as promised (unless the landlord and the tenant either come to a new arrangement or agree to resume the old arrangement – which, in either case, should be stated in a signed and dated writing, in order to protect both parties).
