Question: I moved into an apartment 4 years ago with carpet flooring. I have always been allergic to carpet. Now I want the complex to change the carpet to vinyl flooring planks. Are they required do to ADA and pay for it? They say if I want new flooring, I must pay for it.

Answer: Under the Americans with Disabilities Act (ADA), a person whose disability must be reasonably accommodated is a person whose physical or mental impairment seriously limits their ability to engage in a major life activity. Allergies may or may not constitute a disability under the ADA, depending on the circumstances. You may wish to consult with an attorney who specializes in ADA matters.
