Landlord and Tenant Rights and Responsibilities

questions & answers

Question: girlfriend tenant moved out. took without a written agreement items such as washer and driver ( I am paying on) and sectional sofa (gift from my sister) that I had and were in home before she moved in. police report filed but told nothing to be done but court?

Answer: You could pursue her in small claims court or justice court. Follow this link to show you about the Justice Court/small claims process. There are links for representing yourself, etc.: http://justicecourts.maricopa.gov/CaseTypes/civilsuits.aspx You will need to file in the precinct where she resides. If you don't know, file in the precinct where you reside. If you go to the correct Justice court, they will also have forms up at the counter if you tell them what you are trying to do. You will need to file a complaint, pay the filing fee, arrange to have her served, and then participate in the court process and go to trial if necessary where you will need to prove you own the items and she stole them. The legal term for someone taking something that isn't theirs in a civil (lawsuit rather than criminal) context is "conversion". I always recommend consulting the Arizona Residential Landlord and Tenant Act found here: https://housing.az.gov/sites/default/files/documents/files/AZ%20Residential%20Landlord%20and%20Tenant%20Act%20-%20Revised%20July%203%202015.pdf Please note that I am providing general information based on the very limited information available to me. I am unable to provide you with legal advice, and no attorney-client relationship is created hereby. I wish you the best in this and all your endeavors.
